o Uninstalling Our MobileApplications
Uninstalling Our MobileApplications does not erase your data. If you wish to have your data deletedimmediately, please make a deletion request to privacy@netatmo.com. However, note thatunless opposed by you, We will delete your account and all associated Productdata after three years of inactivity.
· OMAJIN Mobile Application
The OMAJIN MobileApplication allows you to pair the OMAJIN Products
Using Our OMAJIN Productsentails the processing of Personal Data under the following modalities:
o The OMAJINProducts andaccessories S will be processed on the contract basis for product registrationand identification of available WIFI networks purposes.
o The location of yourMobile device will be processed, subject to your explicit consent, forgeofencing purposes in order to determine when you leave your home, in thebackground (even when the app is closed or not in use).
o The language of yourdevice, your city and country will be processed on the contract basis foradapting the language used on your Application.
o The OMAJIN ‘ Productsand accessories name, Home and room names will be processed on the contractbasis in order to personalize your user’s interface.
o The Metrics used for theProducts (Event logs, home occupancy) will be processed on the contract basisin order to personalize the Service to your needs.
o We will also collectmeasurement data relative to each OMAJIN Product on the contract basis andcommunicate it to you on your Application to render the Service.
o The Date and time ofsetup of each Product and the Last time and date of seen for each Product willbe processed on the contract basis for Helpdesk support purposes and to deleteinactive user accounts.
o The following technicaldata: MAC addresses of each Product, Network IP address, Network Transport,WIFI status, Mobile IP address, Mobile type and Mobile version will beprocessed on the contract basis for product registration, execution of theService and maintenance of the Cameras and associated accessories.
The above data is kept for the duration of the contractual relationship (thatends by sending a voluntary deletion request to privacy@netatmo.com). Wealso inform you that, unless opposed by you, your account and associatedProducts data will be deleted after 3 years of inactivity.In the alternative, note that you can reset the Security Cameras or accessorieswhich will result in deleting your Product data.You can delete also the events at any time from the parameter in the settings(a week; month or year). Such events will be deleted from the backend after youdelete them from the SD card of your Product.OMAJIN CAMERAS SPECIFIC - ACCESS TO DATAShall you voluntarily send Us a video taken by your Security Camera when contactingOur Customer Support to report an issue, We may ask for your consent to processsuch data to improve Our algorithms and the performance of Our SecurityCameras.For more information about the data recipients that benefit from an access toyour personal data, please consult the ACCESS TO DATA section.PROCESSING OF SPECIAL CATEGORIES OF PERSONAL DATA AND USERS’ RESPONSIBILITIESWe inform you that Our Indoor Cameras allow the processing of biometric datafor the purpose of uniquely identifying a natural person. This feature isenabled by default. You can disable the processing of biometric data at anytime by managing your settings directly from the Security Application.The data allowing this processing activity are hosted locally on the SD card ofyour Product (profile that you have created, answers that you gave when usingthe algorithm). NETATMO-OMAJIN only hosts the events that you have defineduntil you delete them or for the time-period that you have set at the latest.NETATMO-OMAJIN will not process such data for the purpose of identifying anatural person.Our Security Cameras have been developed for a strictly personal or domesticuse and / or activity.They allow you to determine the purposes and means of the processing activitiesyou want to achieve. As such, you are required to comply with all applicablelegislation regarding the protection of personal data, image rights andprivacy.Should you decide to use Our Security Cameras for a different use, you will beconsidered as the sole Data Controller, NETATMO-OMAJIN remains a DataProcessor.In any case, you are responsible for compliance with any applicable law whenusing Our Products and Services and you must inform your visitors about thefunctioning and operation of the Security Cameras. If necessary, depending onyour processing activities, you may need to obtain their prior explicitconsent.In order to offer you with more convenient and higher-qualityServices with optimized user experiences, we may collect and use certaininformation if you consent to use additional functions in the Services. Pleasenote, if you do not provide such information, you may continue to use basicServices, but certain features based on these additional functions may not beavailable. These additional functions may include:
1)Additionalfunctions based on location information:
When you enable the location-based functions through permissionsettings on your mobile device, we will collect and process your locationinformation to enable these functions, such as pairing with your smart devices.Also, we may collect information about your: a) real-time and precise location,for instance when you choose to use the automation scenarios for controllingyour smart devices, or b) non-precise geo-location when you use certain smart devicesor the Services,
Based on your consent, when you enable the geo-fence feature,your location information will be generated and shared with Google Mapsservices. Please note that Google has corresponding data protection measures,which you may refer to Google’s Data Processing and Security Terms for moredetails.
You may disable the collection and use of your locationinformation by changing your mobile device settings ("My - Setting -Privacy Right Setting - Switch on/off Location Information"), upon whichwe will cease to collect and use your location information.
2)Additionalservices based on camera:
You may use the camera to scan the code by turning on the camerapermission to pair with a smart device, take video, etc. Please be aware thateven if you have agreed to enable the camera permission, we will only obtaininformation when you actively use the camera for scanning codes, videorecording, etc.
You may opt-out the using of camera permission: "My -Setting - Privacy Right Setting - Switch on/off Camera".
3)Additionalservices for accessing and uploading pictures/videos based on photo albums(picture library/video library):
You can use this function to upload your photos/pictures/videosafter turning on the photo album permission, so as to realize functions such aschanging the avatar, reporting device usage problems by providing photo proofs,etc.. When you use the photos and other functions, we will not recognize thisinformation; but when you report a device usage problem, we may use thephotos/pictures you upload to locate your problem.
You may opt-out the using of photo album permission: "My -Setting - Privacy Right Setting - Switch on/off Photo Album".
4)Additionalservices related to microphone-based service:
You can use the microphone to send voice information afterturning on the microphone permission, such as shooting videos, waking up thevoice assistant, etc. For these functions, we will collect your voiceinformation to recognize your command. Please be aware that even if you haveagreed to enable the microphone permission, we will only obtain voiceinformation through the microphone when you voluntarily activate the microphonein the App.

5)Additionalservices based on storage permission(Android):
The purpose is to ensure the stable operation of the App byutilizing the storage permission. After you give or indicate the permission toread/write your mobile device’s storage, we will access pictures, files, crashlog information and other necessary information from your mobile device’sstorage to provide you with functions, such as information publications, orrecord the crash log information locally.
You may opt-out the using of storage permission: "My -Setting - Privacy Right Setting - Switch on/off Storage".
6)Additionalservices based on Notification permission:
The reason why we ask you for the permission is to send younotifications about using the Smart Devices or Services, especially if you havepurchased security services and you require an alert or message so that you cancapture the real-time status.
You may opt-out the using of App notifications: "My -Message Center - Setting - Switch on/off Notifications".
7) Additionalservices based on Alert Window permission：
You may choose to bind a camera in the App and require the Appto display the real-time image of the camera in a separate window.
You may opt-out the using of alert window information: "My- Setting - Privacy Right Setting - Switch on/off Alert Window".
8) Additionalservices based on Bluetooth permission:
You can enable Bluetooth functions after turning on thepermission, including controlling the smart devices, acquiring status of,discovering and configuring smart devices. In these functions, we willcommunicate with smart devices via Bluetooth. Please be aware that even if youhave agreed to enable the Bluetooth permission, we will only use Bluetooth forcommunication in these scenarios: display device status on the home page and smartdevice panel; perform device control on the home page and smart device panel;discovering smart devices on the home page and the add device page, smart devicedistribution network.
You may opt-out the using of Bluetooth via "My - Settings -Privacy Setting - Disable/Enable Bluetooth permission".
Please note that if you turn on any permission, you authorize usto collect and use relevant personal information to provide you withcorresponding Services. Once you turn off any permission, we will take it ascanceling the authorization, and we will no longer continue to collect PersonalData based on the corresponding permissions, and the related functions may beterminated. However, your decision to turn off the permission will not affectthe previous collection and use of information based on your authorization.

o The Research andDevelopment (R&D) teams in charge of our intelligent solutions have, inorder to achieve their missions, access: to customer account data (emailaddress only) (see section ACCOUNTCREATION), the information collected by the technical cookiesnecessary for the proper functioning of the Services (see sections BrowsingOur Website And Using Our Internet Applications and CookiesAnd Similar Technologies Used On Our Mobile Applications ), data processedin connection with the use of the Products (except for biometric data thatremains locally on the Product)
o The teams of ourcustomer support have, for the purpose of achieving their mission, access: tocustomer account data (see section ACCOUNTCREATION), data collected during your contacts with TechnicalSupport (see section CONTACTINGOUR CUSTOMER SERVICE), to the data processed in connection with the use of theProducts except for biometric data that remains locally on the Product)

· The service provider AMAZON WEB SERVICES (AWS) MICROSOFTAZURE, whose data centers are located in the Germany (Frankfurt), responsiblefor hosting the NETATMO-OMAJIN’s cloud architecture hosting all the datarelated to the Products and associated Services;
· The service provider ONLINE, established in France,responsible for hosting historical product data;
· AMAZON WEB SERVICE, established in Ireland, and in chargeof hosting web applications;
· The service provider ADOBE SYSTEMS SOFTWARE IRELANDLIMITED, established in Ireland, for the purpose of sending you directmarketing communications where applicable.;
· The service provider ZENDESK, whose data centers arelocated in Germany, for Customer Support Service purposes. We also inform youthat Zendesk benefits from a “Privacy Shield” certificate and that We have putthe Standard Contractual Clauses of the European Commission in place toorganize the transfer of your data towards the United States of America undersecurity and privacy conditions which are considered adequate according toEuropean legislation;
· The platforms and social media: Facebook, Instagram,Twitter, LinkedIn and YouTube insofar as they have access to your browsinghistory on Our Website and Mobile Applications should you consent to suchaccess. We also inform you that such platforms and social media benefit from a“Privacy Shield” certificate and as such, any potential transfer of your datafor hosting and further processing purposes in the United States of Americawill take place under security and privacy conditions which are considered adequateaccording to European legislation.
