1.- Who is responsible for the processing of your data?

The responsible and data controller for the processing of your personal data is BERGNER EUROPE, S.L., (hereinafter "the PLATFORM" and/or "APP") with C.I.F B-50741925, and registered office at Carretera del Aeropuerto KM.4, Planta 3 Edificio San Lamberto, 50011, Zaragoza.

This Privacy Policy regulates access to and use of the APP (hereinafter, "the PLATFORM") that BERGNER EUROPE, S.L. makes available to Internet users (hereinafter, the "Users") interested in the content (hereinafter, the "Content") and services (hereinafter, the "Services") offered by the PLATFORM on the same.

3.- Information on the data that the PLATFORM collects through the APP

For the proper functioning of the APP, the PLATFORM may have access to the following data provided, where applicable, by the User:

(i) Identification data: name and surname of the user.

(ii) Contact details: email, postal address, country, and telephone number.

(iii) Device data for the correct use of the PLATFORM: the PLATFORM may require the name of the device purchased (if any) in order to offer a service better adapted to the product purchased by the User, the IMEI number, the IMSI number, the version of the operating system, the manufacturing information of the device, the model name and the network operator, IP, among other similar data.

4.- Why is the PLATFORM entitled to process your data?

The PLATFORM's lawful basis for processing Users' data through the APP is the consent of Users to the processing of their personal data, as well as the performance of a contract to which the data subject is a party or the application of pre-contractual measures at the request of the data subject.

In this sense, the PLATFORM processes the personal data of Users in order to enable the commercial relationship requested by the User, to send commercial communications and/or newsletters and to respond to requests for information, complaints, suggestions or any other matter that the User wishes to send through the contact form of the APP, which are related to the provision of the services offered therein.

By accepting this Privacy Policy and ticking the corresponding boxes, the User consents to such processing.

We take the protection of your privacy and your personal data very seriously. For this reason, your personal data is kept securely and treated with the utmost care in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and on the free movement of such data (the "General Data Protection Regulation" or "Data Protection Regulation or GDPR").

This Privacy Policy regulates the access and use of the service that the PLATFORM makes available to the User interested in the services and content hosted on the APP.

With regard to this point, the User may withdraw his/her consent at any time by sending a message to the following e-mail address: info@masterpro.com, without this affecting the lawfulness of the processing based on the consent prior to its withdrawal.

5.- What are the purposes of the processing of your personal data?

Your personal data collected by the PLATFORM may be used for the following purposes, according to the consent given in the corresponding registration form:

(i) Enable the APP to fulfil its function of providing the requested services.

(ii) Receive by letter, telephone, e-mail, SMS/MMS, or by other equivalent means of electronic communication, commercial communications or information about products and services of the PLATFORM.

(iii) To deal with requests for information, complaints, suggestions, or any other matter that the User wishes to send through the contact form of the APP, which are related to the provision of the services offered by the PLATFORM.

6.- Veracity of the data provided by Users

The User guarantees the veracity of the personal data provided and undertakes to inform the PLATFORM of any changes to such data. The User shall be responsible, in any case, for the veracity of the data provided, and PLATFORM reserves the right to exclude from the services any User who has provided false data, without prejudice to any other actions that may be applicable by law.

It is recommended that Users protect their data with the utmost diligence using appropriate security tools. The PLATFORM shall not be liable for any theft, illegal modification or loss of data.

Any modification or update of the data must be communicated to the PLATFORM through the means of communication provided for in this Privacy Policy.

7.- Data retention

The protection of the privacy and personal data of Users is very important to the PLATFORM. Therefore, the PLATFORM makes every effort to prevent the User's data from being misused. Only authorized staff will have access to the User's data.

The User's personal data will be kept for as long as the User's account on the PLATFORM remains active for the purposes of the processing for which they were provided, provided that the User has not revoked his/her consent by requesting the deletion of his/her account or the deletion of certain personal data from the APP.

Subsequently, if necessary, the PLATFORM may keep the information blocked for the legally established periods of time.

The PLATFORM undertakes to comply with its obligation of secrecy and confidentiality of personal data in accordance with the provisions of the applicable legislation.

8.- User rights

Users have the right to:

(i) Access your personal data;

(ii) Request the rectification of any inaccurate data;

(iii) Request the erasure of their data;

(iv) Request that the processing of your data shall be restricted;

(v) object to the processing of your data;

(vi) Request the portability of your data.

(vii) Users shall also have the right not to be subject to decisions based solely on automated data processing.

Notwithstanding any other administrative or judicial remedy, the User shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in case he/she considers that the processing of his/her personal data is not lawful, as well as in the event that the exercise of his/her rights is not satisfied. The supervisory authority with which the complaint has been lodged shall inform the complainant of the progress and outcome of the complaint.

9.- Data security

The protection of Users' privacy and personal data is very important to the PLATFORM. Therefore, the PLATFORM has taken all measures within its power to prevent your data from being misused, allowing access to it only to authorized personnel.

The PLATFORM maintains adequate security for the protection of personal data in accordance with applicable legislation and has established all the technical means at its disposal to prevent the loss, misuse, alteration, unauthorised access and theft of the data provided by the User through the APP, without prejudice to informing the User that security measures on the Internet are not impregnable.

The PLATFORM undertakes to comply with the duty of secrecy and confidentiality with respect to personal data in accordance with the applicable legislation.

The PLATFORM shall not be liable for any damages that may arise from the User's failure to comply with this obligation.

10.- Transfers and/or assignments to third parties

Users are informed that their personal data will not be transferred on to third party or third companies.

The User's data will be stored in the TuyaSmart database as the PLATFORM is integrated into the software tool owned by TuyaSmart, (you can access TuyaSmart's data processing at the following link: http://images.tuyacn.com/app/smart/Privacy_Policy_en.html) and the lawful basis for the process it the need for the execution of the contract to which the User is a party.

Notwithstanding the foregoing, Users' data may only be used by the PLATFORM for any use that serves to properly comply with the purposes of the processing of personal data set out in point 5 of this Privacy Policy.
